He pleaded he was a brewer, and licensed under the Distillation Act, therefore did not require a wholesale license, and there was •no law in force in the district of Nelson, which required him to be licensed as a brewer. The magistrate held that as there was no law in compelling him to be licensed as a brewer he must hold a wholesale license, and fined him £5 and costs. From that decision the appeal was brought. Mr J. B. Fisher appeared for appellant, and Mr Bell for the respondent. Judgment was reserved. »
