RESIDENT MAGISTRATE'S COURT
THIS DAY. ; ■ ', (Before H. C. Lawlor and J. Kilgour, Eeqs., J.P.'s.) PERMITTIHG A NUISANCE.
Albert Dornwell was charged on the information of Mr J. B. Mason, Health Officer for the Borough of Thames, with permitting a nuisance tc exist on his premises known as the Scotia Hotel, the nuisance being an overflowing cesspool. Defendant pleaded guilty but submitted that he was scarcely responsible under the circumstances.
It appeared that the premises on which the nuisance has been permitted to exist are the property of Mr Dornwell, who resides in Auckland, but the house has been for some time unoccupied. There is a sort of right of way from Brown street down the yard, and the closet has become public property. The Health Officer communicated with Mr Dornwell regarding the matter. Some days however, elapsed and nothing was done to abate the nuisance, so an information was laid.
In consideration of the circumstances in which Mr Dornwell was placed the Bench, inflicted the nominal fine of Is and costs.
This was all the business and the Court adjourned. '
