RESIDENT MAGISTRATE'S COURT

Esqs., J.P.'b.) PEBMITTING A. NUISANCE.

John E. Banks was charged with a breach of Bye-law No. 3, Borough of Thames, by neglect-ing to clean his premises situated at the corner of Albert street and Beach Road, Thames, by which neglect a nuisance by an offensive smell was created, on the 18th instant.

Defendant pleaded not guilty. John Brookes Mason, sworn, deposed— That he was Inspector of Nuisances for the Borough, of Thames. Visited defendant's premises on the day named. Found a stable raised about six inches above the yard from which ran silt, which mixing with the surface water caused an offensive smell. It was so for several days. Cross examined by defendant — The weather was fine when witness visited the premises, but it had been raining some days before. Defendant said his yard was lower than the road, and after rain the water lay there. It was cleaned out every week. He thought the sea water percolated throughthe sand and made the yard damp; and he didn't know how to prevent it unless he made a drain right across the beach road. * i

The Mayor thought a drain connecting that running down Albert street would abate the nuisance. Mr Banks said the yard was lower than it. The Mayor then observed that he would have to fill" up the yard, as nuisances could not be permitted to exist from that cause. Mr Banks said he had already put down about 30 loads of gravel.
