The case in which Irvine and Co., Ltd., proceeded against the Dunedin City Corporation for damages was continued in the Court of Appeal to-day. Between December 24 and 29, 1937. water escaped from one of the waterpipes belonging to the Dunedin Corporation in Princes Street and invaded the basement, damaging certain goods belonging to the plaintiff company stored in the basement. Proceedings having been issued claiming £694 2s 4d the amount of the damage, they were moved by consent into the Court of Appeal for argument. Mr A. N. Haggitt, for the Dunedin City Corporation, contended that, by water-pipes having been laid by the corporation pursuant to the statutory authority, the corporation was not liable unless negligence was established against it. and that had not been done. Decision was reserved.
