STATUS OF JUDGE CHALLENGED
MR JUSTICE BLACK OPPOSED United Press Association—By Electrio Telegraph Copyright (Received October 5, 5.5 p.m.) WASHINGTON, October 4. Mr Justice Black took his seat in the Supreme Court without formality and listened inscrutably to the presentation of Senator Levitt’s motion, also to the motion of the Boston Attorney, Mr Patrick Kelly, asking for the appointment of a commission to investigate the legality of Mr Justice Black's appointment.
The Court took the motions under advisement.
Crowds packed the Court and overflowed the corridors and rain-swept steps. Strong precautions prevented the anticipated demonstrations. Another dramatic touch to the situation has arisen from the announcement that Mr Justice Black’s staff will consist of a newly-appointed Jewish youth for law clerk, a Catholic young woman as secretary and a negro as messenger.
