Mr Justice Black took his seat in the Supreme Court without formality and listened inscrutably to the presentation of Senator Levitt’s motion, also to the motion of the Boston Attorney, Mr Patrick Kelly, asking for the appointment of a commission to investigate the legality of Mr Justice Black's appointment.

The Court took the motions under advisement.
