LOSS OF FINGERS
JUDGE AWARDS DAMAGES Bv telegraph- Pres* Association NEW PLYMOUTH, August 21. Damages totalling £1245/11/- were awarded by Mr Justice Ostler in a reserved judgment this morning in favour of Eric Rothery, of Manaia, a butcher’s assistant, against C. Gray and John Duggan, of Manaia, butchers, for the loss of four fingers of the right hand. Plaintiff, who was aged 20, was operating a mincing machine in defendants’ employ on May 1. He slipped and his hand was caught in the machine, which severed four fingers. The claim was for £l5OO general and £45/11/- general damages, subsequently made on the grounds that the moving parts of the machine were not adequately protected. His Honour, in his judgment, said that the loss of four fingers of the right hand was equivalent to the total loss of the hand, and plaintiff might have to reorganise his life, and learn to use his left hand, and follow a sedentary occupation, which would involve long training and practice.
