WRIT AGAINST WILLIE SMITH.

JOURNALIST CLAIMS £SOOO DAMAGES. (United Press Association— By Electrio Telegraph—Copyright.) SYDNEY, August 24. Thomas Harrison, journalist, has issued a writ claiming £SOOO damages against Willie Smith, the English billiard player. The cause of the action is not disclosed. Harrison has been granted leave to issue a writ against Smith on the ground that he is apprehensive that Smith will leave the jurisdiction of the Court before the action comes to trial. Bail was fixed at £5050.

The billiard player Willie Smith was arrested to-day after the issue of a Writ of capais ab respondendum. Sureties for bail of £5050 were provided immediately, and Smith was released.

[The purpose of a writ of capais ab respondendum—survival of an old English legal recourse—is to ensure that a defendant to an action pending shall not leave the jurisdiction of the Court until the case shall be heard and determined. Applicant or plaintiff files an affidavit giving grounds for his fears that defendant will leave the country, and testifies that the claim is bona fide. Defendant is thereupon required to find sureties in forfeit of which he is liable to arrest. SYDNEY, August 24. Mrs Walter Lindrum died in a private hospital last night. In consequence the billiards match between Willie Smith and Lindrum has been abandoned.
