ALLEGED NEGLIGENCE

Wellington, Juno e. Allegations of negligence and breach of duty were tho basis ol a civil action heard by Mr Justice Salniond, at tli9 Supreme Court. The plaintiff, J. A. Chesnam, a farmer, sought to recover £2258 13s 8a from a firm of Wairarapa solicitors, Herbert Hart and Alien Hogg, the claim being for alleged negligence in investing moneys on behalf of plaintiff. For the defence it was maintained anv proposed investments had to be, anil, in fact, were submitted to plaintiff for consideration and approval and llie latter had exercised his own discretion and judgment. AD. reasonable care had been taken by the defendants with reference to the investment.
His Honour gave oral judgment for defendants, remarking that he was unable to roly on the evidence of plaintiff, who had a bad memory. Defendants could not be held legally liable.
