COURT OF APPEAL.
UNIQUE CASE. RIGHT OF OPTION-HOLDER. Per Press Association. Oct. 11. In Morland v. Hales, heard at the last sitting of the Appeal Court, judgment was now given for appellant. Morland had obtained an option to purchase. an estate in M.arlborough. During the continuance of the option, under the impression that Morland had abandoned Ins right, the estate was sold to another. The question. for the Court was, who was entitled to the property. The Judges held that Morland had not abandoned his option, and his position was superior to that of the later comer. Costs on the higest scale were allowed. This case is unique in being the first of its kind, and one jn which it was admitted that it was most difficult to arrive at a decision, as all parties had acted in good i'aith.
