Mr. Emshe contended that the draughtsman of the Borough by-law should have used the words, "hours of darkmtt. instead of between the " hours ..f sunse^ and tunrise." • His Worship, replied that he would not argue the matter. It was absurd and peurile to waste the time of the Court m these cptes by bringing forth arguments that were antiquated 50 or 40 years ago. Mr. Emslie held that his contention was not antiquated ; he had not been m practice 50 or 40 years and he hud heard similar arguments given in his time. H-s Worship, however, declined io liesr anything further from Mr. Emslie. and ini flicted a fine on defendant of 5b and rusts.
