Falla, charged oil remand with accompanying a prohibited person into licensed premises, did- not. appear, Sub-Inspectol (ii-een asked for a fortnight s adjournment and this was allowed. A. Griffin wis charged with refusing to leave-licensed jjremises when ordered to do. so by the licensee. Sub-Inspector■ Green said "accused was using bad language in the billiard room, and was making a nuisance of himself. Accused said lie did not remember using any bad language; lie had been drinking. A fine' of 10s was- imposed ; in default 48 hours imprisonment. . (Before Messrs M. White, 1 and E. I'- ■ Thoreau,' J.lVs.) ALLEGED INDECENT ASSAULT. John Milne;'was charged on remand with on March 16th, assaulting Katlierine Myeiv. with intent. Mi' Raymond appeared for accused, and Sub-Inspector Green prosecuted. He called Katlierine '.Myers.,- who stated that .she was 17 years old, and was employed as a general 'Servant■■•'"at the Saltwater Creek Hotel. She had seen accused .two or, three times at the hotel. On Saturday last witness went into Timaru about 7.30, and; met accused once or twice during ihe evening. ' About a quarter to nine met lier sisters near Shepherd's corner, and accused came up and offered to accompany her home, and she told him she did not want him . She went back to a draper's, and on. coming out mot accused again. After; going to another shop she started to walk home, and accused walked beside her as far as the quarry tramdiue; He then tried to drag her over to 1 the fence, and she screamed and struggled, and accused let her 1 go. but- caughtl hold of her again, and a.ucused put his hand, over her mouth, breaking one of > her teeth in doing; so. jie said that if she did not give in he would make her. She resisted him,.* and lie let her go. Ho picked up a parcel she had dropped and gave it to lieiv ■ She went down to the ; hotel, leaving accused at the top of the hill. He had not accomplished his purpose. She had not.-been out at night with accused before. It was a dark wet" night, and the nearest home was about 100 yards away from the spot where the assault took place. Accused was sober. : To Mr Raymond : ■ Started to walk home with accused from Shepherd's corner on the left-hand side of the street as far as the corner of William Street. Accused went to change his clothes,, and joined her again at-<Cox's,:.store mid they walked together as far as Olipua road. Accused had his arm round her waist. Stopped once notfar fvon Ot-ipua road, whei'ej accused : stopped her again. While: in town accused left witness and; went into the iTimaru Hotel, and also u second time; when lie said, lie was .going to the Shamrock Hotel. .During the struggle a cyclist passed. and witness screamed '. She did not know ..whether- the cyclist was -a man or a -woman ; : the cyclist did not stop; -.-Dr- Unwin stated that, he had made an examinationc.o£ the last witness on Tuesday. There were twoy scratches, .on. her right-..-cheek-,-' signs of a recent- fracture of the : right jaw, a slight abrasion on one elbow, and three very small bruises on the front of the right "thigh:. There- were no signs of violence, and all the injuries were quite trilling. : ; - . At this stage the case wa* adjourned till, 10 o'clock this m'orning.
