Per Press Association AUCKLAND, February 23. At the Supreme Court a decree nisi was granted in the case of Sarah Sadie Vincent v. c John Potter Vincent,, adultery. DUNEDIN, February 23. The Supreme Court was engaged to-day in hearing the cas» Donaghy's Rope and Twine Company v. Wright 'and Stephenson which came before Mr Justice Cooper and a special jury. Defendants had purchased binder twine and it was delivered as required". At the end of harvest 13 tons remained and this by request, was stored for next season. The represntative of the insurance company called at Donaghy and Go.'s office to ascertain which shed the twine was stored in and acording to Lis statement was told that it was in A store. On April 20th, 1905, an accidental fire took place in B store where the twine was stored and to'; tally destroyed the twine. Plaintiffs now claimed £527, the price agreed on. The question at issue was as to whether the plaintiff company had stated that the twine was in A store and defendant.counterclaimed on the ground that when applied to for information, plaintiff gave information that it was in A store and if. as alleged, it was in'B store, plaintiffs were guilty of negligence and of breach of duty, and defendants prayed for judgment for such. neglect and breach of duty. The jury found for plaintiff, but Mr Justice Cooper reserved his decision on a nonsuit point that was raised.
