A WILL CASE.

AUCKLAND. February' 21. A case in which a wrong will was proved, occupied the attention of Mr Justice Edwards this morning, when Mr Stewart applied for the revocation of the will of William James Dunn arid the granting of probate in connection with a- subsequent will made by deceased in April. 1904. The application was unopposed. Mr Stewart explained that Mr Dunn died on December 31st, 1905. Probate was obtained of a will, dated August 6th, 1897. Under this will everything was left to the widow, who was appointed sole executrix. Mr Dunn had made a. second will, under which his wife had a life interest in estate which was worth about £3OOO. after which it went to his children. Mr Buchanan, an Auckland solicitor, and one of the executors, was in England at the time of the death. The widow found a will and took it to another firm of solicitors, under ihe impression that it was the last will. However, when Mr Buchanan returned, he was able to inform them that Mr Dunn had made a. subsequent will. There was absolutely bo blame attaching to the widow The later will -was produced bv Mr Buchanan, who stated that he had acted as Mr Dunn's solicitor during his life, and to his knowledcre there was no will subsequent to April 26th, 1904.

His Honour granted the application, and allowed Mrs Dunn the costs of obtaining the first probate out of the estate." : :
