THE COURT OF APPEAL.
Per Press Association. WELLINGTON, May 1. The Court of Appeal to-day delivered judgment in the claims against the City Corporation for land taken to widen Willis street. The Council asked the Court to set aside the filing of the claims on the ground of failure to give notice of their intention to contest the claims through inadvertence. The Chief Justice in his decision and Mr Justice Cooper held that the Court had no power to give the Council another opportunity of contesting the claims. Mr Justice Edwards dissented holding that it was snatching a judgment against the merits of the case. He thought the Court had power to prevent abuse of the process of the Court. The motions were dismissed with costs on the highest scale. The Council obtained leave tdl appeal to the Privy Council. The Court has adjourned till the 22nd.
