Harbor Board. TIMARU HARBOR BOARD. PUBLIC NOTICE. F Accordance with Section No. 59 of The Harbors Act 1878, Notice is Hereby Given that the Ximaru Harbor Board intend to consider tho following By-Law at a Special Meeting to be held at the Office of tho Board, on Thursday, sth May, 1831, at 11 a.m. By order, W. J. TENNENT, Secretary. Harbor Board Office, ' 25th April, 1881. BY-LAW No. 5. A By-law to reg,ulate tho conduct of shipping, and to fix tho scales of dues, tolls, and charges within the port of Timaru. In pursuance of _ho Harbors Act 1878 and all other powers and authorities enabling them m ithis behalf, The Timuru Harbor Board do hereby make the following By-law for the port of Timaru : — 1. Every person who shall within the port of Timaru commit a breach of any of tho provisions contained m this By-law, shall, on conviction for every such breach, be liable to a penalty of an amount which shall be m the ■discretion of the Court inflicting the same, and shall m no case exceed twenty pounds. "WHABFAGE. 2. From and after the coming into force of this By-law, every person who shall land _ny goods from any ship, cargo boat, or lighter, on any wharf under the control of the Board, or shall use such wharf to ship any goods, •hall pay as wharf dues thereon as follows That is to say : — On all goods, merchandise, and luggage, not otherwise specified, two shillings per ton weight or measurement, m accordance with .the railway usage at Timaru ; minimum charge sixpence. On ships' bread and water tanks, not exceeding sixty-four cubic feet measurement, two shillings and sixpence each. On wool or sheepskins m bales, fourpenco per bale. On grain,pea9,beans, potatoes, flour, pollard, ,or other meal, malt, maize, rye, grain husks, hay, straw, chaff, turnips, carrots, roots, bones, bone-dust, guano, artificial and animal manures, coal, coke, bricks, roofing slates, drain pipes and tiles, road metal, shingle, sand, marble slabs, pyrites, quartz and quartz tailings, fascines, flax, tussock grass, split house blocks, copper, iron and other ores, minerals, lime and limestone, stone (dressed or rough), ono shilling and .sixpence per ton of 2240 lbs. On sawn timber, squared logs, mouldings, piles or heavy timber, fourpenco per 100 feet superficial. On, firewood, ono shilling and sixponce per cord. On posts andrails,.oho shilling ondsixponce per hundred. On roofing shingles, sixpence per thousand. On palings, sixpence per hundred. On horses and cattle, tno shillings and sixpence each. ■ On calves, one year and under, sheep, lambs, pigs, and goats, two shillings and sixpence per score ; minimum charge, sixpence. On carts and drays, two shillings and sixpence each. On carnages, two wheeled, two shillings and sixpence ; four-wheeled, four shillings each. ■ On. ships' ballast (shingle, clay, sand or rubble) when as such only, put from truck standing on wharf into a vessel alongside or but of a vessel into truck on wharf, sixpence per ton ; when discharged from vessel into ballast lighter, or taken from vessel by ballast lighter when lying at wharf or inside breakwater, free. On all goods transhipped into out of or from any -vessel lying alongside any wharf or anywhere inside the breakwater, to be stored m hulks or for export to any other port, half the dues which would be payable m respect of such goods if landed upon a wharf. 3. No charge additional to that which may from time to time be fixed for landing ot shipping, will be made for wharfage, on goods landed or shipped by tbe Harbor Hoard Landing Service either at the Service or at any of the Board's wharves. 4. Any goods remaining on any wharf or m or upon the approaches thereto, or m any store or warehouse belonging to the Board, may be removed by any person appointed by the Board for that purpose to any of the premises of the Board or other convenient place, and may be kept there until payment to the Board of the expenses of such removal and of the keeping of the goods. ' 5. Storage will be charged on all import goods or merchandise not taken away within five working hours from the time of landing, at the rate of one shilling per ton, weight or measurement, per day or fraction thereof ; minimum charge one shilling. 6. Any expense that may be incurred m the removal or Btacking of any goods will bs additional to the above storage rates. 7. It shall not be lawful to remove any goods from any wharf until all entries are passed and all dues paid at tbe offices of the Board, and no goods will be permitted to be removed from any warehouse wharf or other place where the same may have been landed stored or discharged, until a receipt or other authority be produced from some officer or servant of the Board authorised for that purpose, showing the payment or satisfaction of all dues and charges lawfully levied by the Board, and no goods shall be shipped from any wharf or other place until all dues shall bare been paid upon such goods. 8. The times, places, order and mode, of the shipping, unshipping, landing, warehousing, stowing and depositing of goods ; of the landing and embarking of passengers ; and of the taking m and delivery of ballast, shall be regulated and controlled by the Board's ■wharfinger or the person acting as such. BBETHAGE. 9. The master of every vessel shall anchor ©r moor where the Harbormaster or person deputed by him may direct, and ho shall not unmoor or quit the anchorage, nor shall ho haul his vessel alongside any public pier, ■wharf, or jetty, without having previously obtained permission from the Harbormaster or his deputy to do so, and any master off ending against this regulation shall be and be deemed to be guilty of a breach of this By-law. 10. The time allowed vessels to occupy berths at quays, jetties, or wharves, for the purpose ' of discharging cargo, shall be (exclusive of Sundays and holidays and tho day of removal) : — For vessels under 50 tons register two days, and an additional day for every additional 50 tons Tegistor. 11. Vessels occupying berths at the wharves •will be charged three pence per ton on all cargo landed or shipped, to be paid to the Collector before the vessel shall be removed. 12. Yes9el_ receiving or discharging cargo at moorings iniide the Breakwater, or occupying a berth outside another vessel, will be charged half berthage rates. . Cargo will bo computed for berthage as follows :— Timber, native, 480 superficial feet to the ton. Timber, hardwood, 320 superficial feet to the toe. Posts and Roils, 50 to the ton. Palings, 320 to the ton. Wool, 5 bales to the ton. All other goods as for wharfage. 13. It shall be competent for tho Harbormuter or a person deputed by him, to order that any. Tessel, lighter, or boat bo removed from any berth alongside any wharf, or from any 1 anchorage to any part of the Harbor, ■whenever such removal shall, m his opinion, be proper" for the general accommodation of tho shipping. - And any person who shall fail to obey such order or otherwise offend against this regulation, shall be and be deemed to bo guilty of a breach of this By-law. 14. Before any vessel or boat is removed from any wharf or jetty, the master or other person m charge of tho said vessel or boat ■Hall cause all dirt or rubbish to bo thoroughly cleared from that portion of tho said wharf or jetty ocenpied by such vessel or boat ; such dirt or rubbish to bo deposited at such places as may bo appointed by tho Harbormaster. Any neglect of this regulation will bo and be deemed to be a breach of this By-law. OBAIfAOB. ' 15. Tho cranes provided by tho Board will be sent to vessels at the request of tho master and while working at any vessel will bo held to b« part of the ships' appliances ; and any damsgo which may occur to tho vessel or crane by faulty slinging, catching on coamings or rigging, breaking of chains, slings, or from any other cause whatever, shall be nt the risk of the master or owner of such vessel; 16. Tho charges made for the use of tho Board's cranes will bo sixponco a ton on all
