DRIVING STOCKS.
ADDINGTON BY-LAWS. PER PRESS ASSOCIATION. • CHRISTCHURCH, September 14. Mr. T. B. -Bailey, S.M., delivered his deferred judgment in several cases arising out of informations laid under tho Riccarton Borough Council's by-laws relating to driving stock to and from Addington saloyards. Tho magistrate said that tho facts were not disputed. Tho defence raised whs that the bylaws were ultra vires and unreasonable. After reviewing tho evidence ho had como to tho-■■conclusion that tho restrictions were unreasonable. Regarding tho legal aspect ho said that it was not at all clear that tho Bprongh Council had power to limit tho hours during which stock might bo driven along the streets. Power was given by the Municipal Corporations Act to prescribe tho route by, which cattlo may bo driven, but nothing.was said about tho times, and any power to,make bylaws as to time was by inference only, from other sections of the Act. All tho informations were dismissed. Counsel for tho Borough Council.said that ho could, not, at this stage,, definitely state that an appeal would bo mado, but bo asked that in the case of an appeal the security required should ho stated. The amount was fixed at £5 5s for each case.
