MAGISTRATE’S COURT.

TO-DAY’S SITTING,

In the Magistrate’s Court to-day, before Mr. A. Crooke, S.M., in the following undefended cases, judgment was given by default.; —Bullock and Johnson (Mr. Hutchen) v. John 'William Ward, claim £5 15s, costs 23s 6d; S. W. White (Mr. Hutchen) y. Charles S. Cottam, judgment for costs only, ss; Sargood, Son, and Ewen (Mr. Weston) v. William T. Cleaver, claim £25 4s, (£2 19s); W. ’L. Gordge (Mr. Bewley) v, Frank Cowell, claim for costs only, ss; the Public Trustee (Mr. A. H. Johnstone) v. John Gilmour James, £lO 3s (£1 10s 6d); Mrs. Burgess (Mr. Hutchen) v. Thomas Brash, judgment for costs only, 7s. In a judgment summons case L. F. Webster v. Alexander Ross, an order was made, on the application of Mr. C. H. Weston, for the payment of the sum of 6s 9d forthwith, in default 24 hours’ imprisonment. In the adjourned case of the Official Assignee v. Bertha Jamison, in which Mr. David Charteris, land agent, sought to recover commission on a sale of property to defendant, Mr. C. H. Weston announced that plaintiff had withdrawn his action. Mr. Frank Wilson, counsel for defendant, applied for costs, but Mr. Weston objected, asking his Worship to exercise his discretion and disallow costs, giving as his reason that he had not been advised of the assignment of amount of the commission claimed to Mr. R. C. Hughes, prior to the hearing of the case in court, and also that plaintiff was an officer of the court. His Worship, however, overruled the objection, as he considered that Chartoris should have advised the Assignee of the t“,uisaction which took place prior to his bankruptcy, and awarded costs to defendant amounting to £2 2s.
