RAILWAY APPEAL BOARD.

_ ~ * Per Press Association. WELLINGTON, Oct. 30. A sitting of the North- Island Railivay Appeal Board was held to-day. Thomas Bartosh, railway porter, Waipukurau, appealed against his dismissal from the service for alleged attempted theft. Judge Eyre Kenny presided, and Mr C. P. Ryan represented the first division and Mr P. Reddington the second division. Appellant was represented .by Mr Martin Lee (guard), and Mr R. W. McVilly (chief clerk) conducted the case for the Department. Appellant had been tried before two Justices on the charge preferred against him by the police, but the case had been dismissed. Appellant detailed the circumstances of tne case and the stationmaster gave his version of the affair. The Board reserved its decision. C. F. Hill, stationmaster at Masterton, appealed against his position in the classification list, the district officer having withheld a certificate for promotion. After the Board considered the point, in committee, the chairman said the Board was of opinion that it had no jurisdiction to entertain an appeal where the aggrieved person complained of refusal of promotion. The only appeal contemplated by the Classification Act was where a man with a certain increment attaching to his position was refused a certificate! by the General Manager and thus prevented from obtaining his increment. The Board had no power to deal with appeals relating to promotion.
