April 21.— Bofore W.Sluart. Esq. K.M. J, Gorrie v D P. Groenway. Chim £4 6s 6d, balance of"o f " account for express wheels. Mr Fookes for plaintiff, and Mr McDavitt for defendant. Plaintiff and D. Clauston gave evidence to show the wheels had been made to defendant's order. Defendant pleaded that tho wheels were not satis factory and wore charged at a higher rate than he had agreed to pay. The point was as to whether a certain fencing job undertaken ami party carried out by plaintiff und his mate Smythe was done by contract or day labor. Mr McDavitt for plaintiff, and Mr Fooke3 for defendant. Thi9 was a long and intricate case. Plaintiffs contracted to supply logs to defondant's mill at tho Boaconsfield Road, and alleged that they were delayed in their work and sustained loss owing to tho mill being unable to take the logs fast enough; also that defendant had refused to pay money duo. Dofondunt and his son swore that the plaintiffs were never delayed in their work as alleged, and thnt the reason they had not received the money was that they wore at that time and are now in debt in concoction who the payment for bullocks for carrying on thiir work. Evidonco was givon at groat length, and at 7.45 p.m. the further bearing was udjournoi until Monday.
