DISTRICT COURT— In Bankruptcy.
THIS iSA-"if. Tuesday, November 18s. — Before His Honor Mr District Judge Kettle. MOTION TO DECLARE VOID. Mr Roy, on behalf of the Official Assignee in the estate of Lewis and Walter Read, of Opunake, moved for an order to declare void a transfer of a waggon and four horses, valued at £70. In January last the bankrupts bought the waggon and team from Messrs Nolan, Tonks & Co., of Hawera, upon bills. The delivery of the waggon and team was given, but the bills were nover signed. Early in May last the bankrupts returned the waggon and team to Messrs Nolan, Tonks & Co., at their request, and about three weeks afterwards they filed their petition in bankruptcy. Mr Roy now moved for an order declaring the giving back was a fraudulent preference under "The Bankiuptcy Acts of 1884 and 1885." Mr Barton appeared on behalf of Messrs Nolan, Tonks & Co. to oppose. The, case was adjourned from last Tuesday after the evidence of Lewis Read, and part of Walter Read's was taken. Walter Read's evidence was continued to-day. The D.0.A., R. G. Bauchope, also gave evidence.
