Thursday, September 8. — Before R. G. Baucbope, Esq., Deputy Official Assignee.

BK JOHN MYNOTT.

A general meeting of creditors in tbe estate of John Mynott, late storekeeper, and called together by the Assignee at tbe bankrupt's request to consider the bankrupt's application to be recommended for his discharge was held in tbe Court-room on Thursday. The following creditors were present or represented :— W. Outfield (Mr. T. King), £161 3s; J. Myers (Mr. A. Goldwater), £15 10s; J. Lindsay, £10; A. Marsh, £7; W. Crowe, £7; T. Clare, £15 17s sd; 0. M. Lepper, £62 lls 6d; W. Brown (Mr. M. Lepper), £65 lls 61; W. McArthur & Co. £46 9s Bd, W. J. England £3 6?, J. Sarten £60 12s Id (represented by Mr. Dockrill); S. Ruudle, £59 3a 3d; J. Sampson, £74 17s sd; Northern Boot Co. £105, B. Toaks & Co. £17 16s 93, A. Heather £108 7s lid (represented by Mr. F. P, Corkill); N.Z. Loan & Mercantile Co. £390 10s 10 i, Newton King £481 Bs, W. G. Neill £28 6a 8d (represented by Mr. J. P. Eagles); R. C. Hughes, £2 8s8d; Tbeo. White, £80, The bankrupt was also present, Mr. Hughes appearing for bim. The Chairman stated the reasons of the meeting.

Mr. Hughes said that it was a mere matter of form to apply in this way. Mr. Mynott had been engaged by the Cooperativo Society, but bis work having ceased there, he wanted to be untrammelled, so as to earn a livelihood to support his family. Should not this application be acceded to, then Mr. Mynott would look to the creditors for a weekly sum to maintain bim while uncertificated and unable to start work on his own account. His client had been subjected to petty annoyances from some of his creditors, but ho (Mr. Hughes) would say that tbe Assignee had always been courteous and obliging. [Mr. Hughes then read certificates which Mr,'. Mynott bad received when in tbe 43rd Regiment, aud from gentlemen in. Auckland and elsewhere, which all" testified to Mr. Mynott's good character and straightforwardness.] lie (Mr. Hughes) thought that these were complete denials to all disparaging assertions that had been made about bis client's acts. He hoped, in conclusion, that the meeting would be in favor of Mr. Mynott's getting bis discharge. Mr. Marsh proposed, " That this meeting recommend tbe Court to grant Mr. Mynott's discharge." — Seconded by Mr. T. Clare. On division the voting was as as follows : For, Messrs. Marsh, Clare, Rundle, Sampson, T. White, Crowe, Lindsay, Lepper, (also for W. Brown), A. Goldwater, Dockrill (3 votes)' ; Noes, Messrs. F, P. Corkill (B. Tonks & Co.), T. King (W. Outfield), and J. B. Eagles (3 votes). Total of amount against, £1097 4s 5d ; total for £550 7s 6d.

According lo the provisions of the Aot the Chairman said the motion was lost.

Mr. Hughes wanted to know if Mr. Corkill was instructed to oppose Mr. Mynott's discharge.

Mr. Oorkill : I refuse to be accountable to you for my actions.

Mr/ Hughes read telegrams from Heather & Co. and Northern Boot Co., who did not oppose the bankrupt's discharge." ' .

Mr. Corkill sjid he only voted for Heather & Co. He had no knowledge of tbe telegrams in Mr. Hughes' possession. The proxies were unsolioted by bim. Mr. Hughes moved the adjournment and Mr. Dookrill seconded tbe motion.

Mr. Mynott at this juncture made some statements about Mr. Corkill, when tbe Chairman ruled him out of order, as he was not speaking to the motion.

Mr. Bundle said the best way Mr. Mynott could ventilate the statements was to put it in print. The motion for adjournment was then withdrawn. Tbe Chairman said he was willing to call another meeting to consider tbe bankrupt's discbarge. He could not hear Jirrevalent discussion now the object of the meeting was -lost; and all be would do was to declare the meeting closed.

Mr. Hughes again read telegr&ms from outside creditors which did not oppose tho bankrupt's discbarge. The Chairman then closed the meeting.
