Saturday, September 11.— Boforo C. E.
Rawson, Esq., R.M. BREACH OF .AGREEMENT. ' Edward Parkin v. Charles Warneford. This was a claim for £28 12s. 31. for breach of agreement.
Mr. Govett appeared for plaintiff. The statement of claim was to tho effect that plaintiff leasad 24 acres of laud in tho Moa District to defendant for a torm of 3 years from the Ist August, 1886, but tho defendant had since in onnod plaintiff that he would not comply with the terras of tho lease. Wherefore, £17 was claimed for special damages, and £11 12s. 3d. for costs of division fencs erected by tho plaintiff in accoi dance with the covenant.
His Honor non-suited plaintiff on tha ground that no breach of covenant was disclosed. That the defendant should inform plaintiff ho would aot comply with the covenant did not in this instance constitute a breach. The Court rose.
