KILLED ON WAY TO JOB
CLAIM BY BOY’S MOTHER
RIDING HIS EMPLOYER’S BICYCLE.
COURT RESERVES ITS DECISION.
UNUSUAL COMPENSATION ACTION.
By Telegraph—Press Association. Wellington, Last Night.
Ethel Clausen, as the mother of the deceased Lawrence Clausen, to-day claimed compensation in the Arbitration Court from the Couchman Cycle Co. Ltd., as compensation for the loss sustained by her as a partial dependent, and £2O funeral expenses, costs of the action and such further relief as the court might deem just. Decision was reserved.
The boy fell under a motor-lorry while cycling to work last June. It was claimed for Mrs. Clausen that because her boy was riding a vehicle provided by his employer for travelling to and from work she should succeed. The defence says that as the boy was not required to ride a bicycle, and as he had not reached his place of employment the claim should fail.
Saying that the case was somewhat unusual, Mr. Justice Page announced that the court would give a written judgment.
