COURT OF APPEAL DECISION.

Wellington, April 15.

The Court of Appeal’s reserved judgment has been delivered in the case, Turner v. Turn-'r, which was heard on March 12. The court held that, inasmuch as the order made in a suit in 1932 had expired prior to the hearing by Mr. Justice Ostler in December, 1934, it was not open to that judge to make an order affecting the accumulative arrears as he had done and consequently his judgment must be varied by striking out that portion which remitted the arrears. The reduction of the amount of the alimony to £2 per week for two years should stand. Costs of 15 guineas were allowed Mrs. Turner.
