ORDER FOR EXTRADITION FRENCH APPEAL TO ITALY TWO CROAT TERRORISTS STRAIN UPON RELATIONS By Telegraph—Press Assn.—Copyright. Rec. 7 p.m. Rome, Nov. 26. The court at Turin has refused a French request for the extradition of Pavelitch and Kvaternik, members of the Croatian terrorist organisation responsible for the death of King Alexander of Yugoslavia. The decision is not surprising here. The opinion was expressed that the assassination was a political Crime, which is excluded from the Ftanco-Italian extradition agreement. Apart from the legality of extradition it is considered that Italy is not obliged to help France in this respect. Commentators add that if Signor Mussolini was not guarded he might be assassinated as the result of plots allegedly hatched in France. The decision will nbt improve relations between Italy and Yugoslavia, where Pavelitch has already been sentenced to death.
The Appeal Court's decision is equivalent to finding there is no case for trial, Says the London Times correspondent. It was Stated in reply to an inquiry whether Pavelitch and Kvaternik would be tried that trial was impossible in the absence Of an indictment, which it is believed is unlikely to be forthcoming. It is revealed that he told a friend King Alexander would never reach England alive.
He was himself last week ordered to leave England and became nervous and depressed. Hfe Said he wbuld be dead within 24 hours bf arriving in his own country and he feared assassination in England. He appeared tb be familiar With all the secret societies in the Balkans and he slept With a sword beside him.
