LOAN BY DEAD MAN
JUDGMENT IN PICTON ACTION. DEFENCE OF GIFT NOT UPHELD. By Telegraph—Press Association. Blenheim, Nov, 26. ' In the Supreme Court this morning Mr. Justice Blair delivered reserved judgment in a case in which a widow and administratix of the estate of Charles Nicholson Dawkins, Sydney, claimed to recover £2708 from Reginald Gerald Dawkins, Picton, auctioneer. The plaintiff claimed that the money was lent to the defendant, a brother of her husband, in 1920, and defendant claimed that the amount was a gift. His Honour found that the transaction was a loan, not a gift, according to the statements in the correspondence between the brothers, and found for plaintiff for the full amount with costs on the highest scale.
