DEFENDANTS DO NOT APPEAR.

DECREES IN SUPREME COURT.

Undefended petitions in divorce were heard by Mr. Justice Smith in the Supreme Court at New Plymouth yesterday. Decrees nisi were granted in every case where applied for. Robert Whale (Mr. W. Middleton), vulcanising engineer, New Plymouth, petitioned against Iris Agatha Whale for the restitution of conjugal rights. The parties were married on January 20, 1914, and lived together until April when Mrs, Whale left her husband. She was living at New Plymouth,

Evidence was given by petitioner and Ernest Milner and the decree was granted, to become operative 14 -days after being served. Sarah Dean Marsh, New Plymouth (Mr. H. S. Weston) petitioned for a divorce on the grounds of separation against Aaron James Marsh. The pair were married on April 28, 1924, at Inglewood and lived at Hillsborough. There were two children, for which custody was not asked. A deed of separation entered into on August 28, 1931, had been in full force. There was no question pi maintenance.

Dora Rogers, married, Bell Block, sister of plaintiff, gave evidence, A decree nisi was granted to be made absolute after three months, with costs on the lower scale to respondent. Myra Margaret Cameron, New Plymouth (Mr. John Houston) was granted a decree nisi against Allan Francis Cameron. The parties were married at Hawera on September 23, 1924, and lived at Porangahau and Takapau, Hawkes Bay. They agreed to separate on February 2, 1931. Armitage, bootmaker, New Plymouth, gave corroborative evidence. A decree nisi was granted. Anthony Moratti petitioned for the dissolution of his marriage with Maida Velma Moratti on the grounds of adultery with Robert Stokes, Tongaportitu. A decree nisi was granted, with custody to Moratti of the two elder of the three children.

Moratti, a labourer of Midhirst, represented by Mr. N. H. Moss, said he was married on November 29, 1924 at Stratford, and there were three children. His wife left him on January 7, 1934, with Robert Stokes and lived with him for six weeks at Tongaporutu. She had come back twice since then but went away with Stokes again and was living with him at present. William Thomas Bell, labourer, Inglewood, gave evidence of seeing Mrs. Moratti with Stokes, and a letter of admission from hfir was produced. Athol Leslie Salter, dairy factory-as-sistant, Hawera (Mr. A. K. North) petitioned against Laura Muriel Salter On the grounds of her adultery with Jack Hamilton.

Salter said they were married on December 3, 1929, and there were no children. Because of his wife’s attentions to another man he left his holrte on Jufie 4 this year. On October 16 he entered the house, occupied by his wife and discovered her and Hamilton together Gillies Francis Nicole, inquiry agent, Wellington, said he was with Salter when the house was entered, having kept watch during the evening. A decree nisi was granted. Decrees nisi were made absolute in the following cases: Thelma Daisy Florence Philpotts (Mr. G. Macallan) v. Thomas Arthur Philpdtts; Olive Ray Martin (Mr. L. M. Moss) v. Matthew Patrick Martin; Albert Ernest Gernhoefer (Mr. P. Thomson) v. Annie Elizabeth Gernhoefer and Cyril Wilmot Chainey; Olive Pickering (Mr. Macallan) v. Allan Pickering. BANKRUPTCY MATTERS.

Discharges in bankruptcy were granted to William Henry Turchi, Tatiu-aimaka, labourer (Mr. G. Macallan) and George Robert Mumby, Inglewood (Mr. N. Little). The deputy official assignee at New Plymouth (Mr. J. S. S. Medley) and the official assignee at Hawera (Mr. C. O. Pratt) were released from administration in a number of estates.
