MONEY FROM ESTATE
APPLICATION BY WIDOW.
£lOOO DOCTORS’ BILLS.

Application under the Family Protection Act for immediate capital provision out of an estate from which the income had been bequeathed to her for life, was made in the Supreme Court to-day 'before Mr. Justice Ostler by Mrs. V. L. O'Connor. Mr. A. M. Ongley appeared for plaintiff, and Mr. J. P. Innes for the Public Trustee, the executor of the estate of the late Patrick Francis O’Connor, jeweller, of Palmerston North. Mr. H. R. Cooper represented, as guardian ad litem, the children of deceased. It was stated by Mr. Ongley that deceased had left Mrs. O’Connor the whole of the income on an estate of £16,000 for life. Plaintiff, however, had to meet outstanding doctors’ bill totalling £979, and had also used up, in maintaining herself, during the last nine months, a capital legacy of £250. Apart from the estate in question, Mr. Ongley continued, deceased’s children were amply provided for out of their grandfather’s estate. All that plaintiff asked for was payment of £1250, of which £lOOO was to meet the doctors’ accounts. She did not want to.alter the will or attack the charitable trusts.
Mr. Innes said he had instructions to submit to any order made by the court, and Mr. Cooper intimated that the children wanted to help their mother. The position had been investigated and the application was quite a proper one. His Honour, who remarked that the doctors appeared to have had a feast, made an order that plaintiff be paid £1250 out of the capital of the estate. Costs were allowed, to be paid out of the estate,
