The question of whether a joint of meat offered with other articles constituting a meal and sold over the counter of a grocery shop constituted a retail sale was discussed before Hr. J. L. Stout, S.M., in the Magistrate’s Court this morning, when Community Stores Ltd. were charged with offering meat for retail sale without the written authority of the Palmerston North City Council, The city solicitor said that tire defendants had offered for sale on June 2 a joint of meat and other articles to make up a meal. Counsel for defendants said there was no definition in the Health Act to say what constituted a retail sale. Mr. Stout said he was satisfied that defendants had made a breach of the Act, but as the action was a test case he would impose a nominal fine of £1 and £1 14s costs.
