DISAGREEMENT BY JURY
bookmaking allegation CHARGE AGAINST D. SISARICH i NEW TRIAL ORDERED BY COURT. POLICE VISIT TO RESTAURANT. There was no hope of reaching an agreement, said the foreman yesterday when, after being out four hours 42 minutes the jury was recalled from consideration of a charge against Dominik Sisarich of carrying on business as a bookmaker at Stratford. On the application of Mr. R. H. Quilliam (Crown Prosecutor) Mr. Justice Reed ordered a new trial for next session. , , Mr. A. Coleman succeeded with an application for the readmission of Sisarich to bail in a personal bond of £lOO and another of £lOO. ... . The conviction of Sisarich for dockmaking in 1931 was recalled by Detective Meiklejohn. Sisarich had then been fined £2OO. He produced certified copies of race books for the New Plymouth, Rangitikei and Wellington meetings held in February and March. The horses mentioned on the slips of paper found on Sisarich’s premises had beep engaged at these meetings, also the horses on which Constable Groombridge had made bets. The slip found was made out in the way usual for settling slips. The writing on the slips was Sisarich’s in witness’ opinion. To Mr. Coleman: He admitted the account-notebook found might be used in the restaurant business, though he had never found slips made out for a restaurant business in the manner these were made out. The sports guide and the account-form books were of a type widely in use by bookmakers. This concluded the case for the Crown and Mr. Quilliam addressed the court. He was followed by Mr. Coleman, who did not call evidence. His Honour summed up, and the jury retired at 11.47 a.m., to be recalled at 4.30 p.m. to announce a disagreement.
