For driving a motor lorry licensed to carrv not more than 4J tons total weight over the main North Road at Urenui, on April 19, the total load being nearly 7 tons, W- D. Winstanley, a Waitomo carrier, was fined £2 (costs £1 Ils), by Mr. R. W. Tate, S.M., in the Waitara Magistrate’s Court yesterday. Winstanley was charged on the. information of Mr. G* Rowe, Clifton County inspector. Counsel for the inspector said the case was one in which the total weight of the lorry was more than Winstanley was licensed for rather than a case or carrying too much for the road, Winstanley had a load of 80 or 90 bags of superphosphate and the weight ot the lorry and the load was between 6$ and 7 tons. He should have paid ft license fee of £S 10s but he was licensed to carry only 4J tone, the license for which cost £1 ss. For Winstanley his counsel said that in the Waitomo county, in which Wmstanley’s headquarters were fixed, it was impossible for him to take out a heavier license than he had. The county council w'as not empowered to grant. licenses over 4J tons. Winstanley did little carrying but at times he came into New Plymouth and took a load of manure back with him. He had since paid the license fee for a 6J ton load even though it would be of little us® to him. ft w*as not ft case where a man was carrying a heavy load and damaging the roads. Mr. Rowe said other Waitomo carries had taken out a license for an extra ton in the summer months but Winstanley had not done so. Peter Isaacs, Ils 6d (I3s); K. L. Barclay v. Ike Moa, £1 Ils 6d (13s); E. Reynolds v. Ike Moa, £2 15s 6d (£1 8s 6d). , Under judgment summons proceedings the following orders were made: A.°G. Clark to pay I. J- Bridger. 19s. 9d forthwith, in default one day's imprisonment; D. V. Whitlock to pay M. Box £2 19s forthwith, in default three days’ imprisonment.
