BANKRUPTCY AND DIVORCE

MOTIONS IN THE SUPREME COURT. Discharges from bankruptcy' were granted yesterday by Mr. Justice Blair to Douglas Clement (Mr. A. Chrystal) and to Max Mendels (Mr. C. E. Monaghan).

Phillip Ernest Warner (Mr. R. C. Rutherf urd) was granted his discharge conditional upon his paying within 18 months £lOO to the deputy official assignee who, upon payment being made, will assign to the bankrupt the bankrupt’s interests in the estate of Henry Warner, deceased. Mr. A. K. North appeared for a number of creditors.

Motions for the release of the official assignee in 21 estates were granted. Mr. North applied for the discharge of Wilfred Charles Judd. The deputy official assignee (Mr. J. S. S. Medley) reported, however, that Judd, who had been in partnership with a man named Saunderson, had disappeared and had never attended a meeting of creditors. Considerable trouble had been .experienced in tracing him. It was desired to obtain from him particulars of his interest in his father’s estate. Mr. Medley understood bankrupt’s interest in the estate was in the proportion of onesixth, but the details had not yet been supplied. His Honour: Then I am not going to grant the discharge. The application will be dismissed. I am not going to encourage bankrupts to neglect their obli-. gations. Mr. North explained that the matter came from his Stratford office and he had not been aware of this aspect. In view of the payment of the fees, however, he suggested the motion might be adjourned and not dismissed. , His Honour: What I am going to do is to dismiss it.

A decree nisi in divorce was made absolute between Elizabeth Vera Seager (Mr. A. A. Bennett) and Reginald Eugene Seager. Custody of the children was given. the petitioner, with the right of access by respondent.
