AN UNDISCHARGED BANKRUPT.

CREDITORS OF J. A. W. H. MOODY.

' Attributing his failure chiefly to the general economic conditions which had rendered his business as a commission agent unprofitable, Joseph Arthur H. W. Moody, New ' Plymouth, appeared in bankruptcy before the D.0.A., Mr. J, S. S. Medley, yesterday. There being no quorum of creditors the meeting was adjourned cine die. The bankrupt was ■examined. Mr. R. J. Brokcnshire appeared for Moody and the only creditor present was Mr. R. Wright. Mr. Medley said Moody was adjudicated bankrupt in Auckland in 1927, was undischarged and had filed again, having incurred nearly £3OO in debts.

Unsecured debts amounting to £294 12s 5d were the only debts, and there were no assets.

In a personal statement Moody said he was adjudicated bankrupt in Auckland on May 27, 1927, on a creditor’s petition, from which he had not been discharged. As a result of that bankruptcy he felt constrained to give up his position as an insurance manager. He came to New Plymouth, and after a long period of unemployment (he did every kind of casual work that offered) until October, J 928, he obtained a position, as salesman with an insurance company. He retained that until February, 1931, and was now employed in similar work on a commission basis. He had a wife to support and three children of school age. He attributed his failure chiefly to the general economic conditions, which had rendered the .business of a commission agent unprofitable. Nearly all the debts were incurred in connection with that business. His present earnings did not permit him to make any offer to jiis creditors, but he hoped eventually, ' with the coming of better times, to discharge them all in full. Examined under oath bankrupt said that in the course of his business he had to travel around with his inspec-tor-general all over the country. Addressing the bankrupt, he said: “By the amount of benzine you. have used you nujst have travelled’ a good many thousand miles.” -—“Yes.’*

Mr. Wright: “I suppose a good lot of the benzine was for joy-riding. You were out oh Sundays a fair bit.”—“l suppose you can do business on Sundays.” rMr. Wright: .“Not too well.” Speaking for bankrupt, Mr. Brokenshire said that a car was . a necessity in his business, otherwise he could not earn a penny. Mr. Wright: He hasn’t beep a trier. Go and look at tile place I let him. He did not grow a vegetable. Bankrupt: You cannot do business all over the country and keep a garden too. Mr. Broken shire: There is some excuse for a man who is pressed on all sides.
