JURY DISCHARGED BY JUDGE A UNUSUAL DEVELOPMENT IN COUR’tif TNVERC.ARGJLL COLLISION ’ i By Telegraph.— -Press Association. Invercargill, Aug.. 20, A singular development occurred in the Supreme Court to-day in a case in which Margaret Mcßeath is suing for £2500 damages against Roy Rankin Wallace and Fleming and Cc., arising out of the death of her husband, the driver of a baker’s cart as the result of a collision, with a motor-car. The ease came on as a rehearing on the ground that the verdict for £1250 damages at the previous session was against tho weight of evidence. •Several witnesses were examined yes-: terday and, when the court resumed, '• counsel for plaintiff said circumstance® had arisen. -which counsel agreed Tendered it a proper case to be withdrawn from the jury and set.down for trial later . y consent of both parties. His Honour discharged the jury and ordered a new trial next session, remarking “counsel have told me in chambers the reason for the application and there is no need to give that reason here.”- ' ’•
