CRASHED INTO TURNING CAR
MOTOR CYCLIST CLAIMS Wj-J. py Telegraph. —Press Association. Wellington, Last Night. Contending that the accident would Lave been avoided if defendant iad giv. en A sigu&i, Arthur Hirschorn, a salesman, Upper Hutt., sued Leonard Myvevu Wallace, Wellington, for £.659 general and special damages arising from a. collision on the Hutt Road on May 24. The. case began to-day in. the Supreme Court, In his statement of claim. Hirschorn alleged that as a result of the defendant’s negligent, and unskilful driving of a motor-ear he had been thrown from his, motor-.eycle and. seriously injured. His injuries consisted mainly of a fractured wrist, a, fractured clavicle and severe head and knee injuries. . Hirschern was an inmate of the Wellington hospital for over a month and. he would be required to, attend daily for treatment, as an out-patient for a further period Ho would be unfit for his employment for three months. Evidence was given by Hirschorn that just prior to the- accident he. was passing a ear which was travelling in the same direction towards Petone. Another’ ear Hirschorn had previously noticed standing on the left hand side of the road on the macadam- suddenly swung out in front of him. He realised it was impossible to go between the two ears and decided to go ‘ to the right to avoid a collision. His machine struck the second car, however, and he was thrown heavily to the road. For the defence it was contended that Wallace did not signal because he had plenty of time to turn across the road before the car in the rear came up. Hirschorn suddenly came up behind the etho car at a speed one witness placed at 45 miles an hour. The. accident, contended the defence, was due solely to the excessive speed at which Hirschorn was travelling. The case will be concluded to-mor-row.
