Mr. Justice Luxmcro decided that the "Silver Wings” air was not taken from “Madame Butterfly.” There was nothing in. th© case to establish infringement of copyright. The owners of the copyright of “Madame Butterfly” contended that airs from that opera formed the basis of items in “Silver Wings,” a musical play now being performed in London. The defence denied th© allegation, and said that the fundamental air of one of Lhe songs complained of was taken from a Sankey and Moody hymn.
