ALLEGATION OF SLANDER
SCHOOL. TEACHER NON-SUITED. By Telegraph.—Press Association. ■< Auckland, Nov, 21. . The Supreme Court was occupied with an action for alleged slander and a claim for £550 damages brought by Percy McDonald, teacher of To Rapga, against Thomas Randall Jenkins, farmer. Plaintiff alleged that defendant eaid to another farmer: "Have you heard of the trouble that McDonald had, interfering with big girls at the school?” Mr. Justice Smith said: "Defendant was chairman of the committee of the country school. In my opinion, on the ground of common interest he was within his duty in discussing the matter with a parent. I think it is a case of gratified privilege. There is no evidence of malice.” Plaintiff was non-suited.
