EFFECT IN NO-LICENSE DISTRICT.
DISPUTE OVER PROPERTY SALE.

The hospital board some months ago sold its Kamo Springs property to an undisclosed Auckland principal for £3912, subject to a publican’s license for the building being granted .to the purchaser. A license was -duly granted by the Marsden licensing bench, but two days before the bar was opened an -objection was made by the New Zealand Alliance, which, however, decided to postpone action pending the decision in the Ashburton case, which was regarded by both parties as a test case. The hospital board to-day advised that the principals, Messrs. J. Troy and Kells Mason, Auckland, did not regard the purchase as valid in view of the Supreme Court judgment and the alliance’s objection. The board, after heated discussion, pending legal advice, resolved to refuse to sign the agreement endorsing the principals’ contention that the sale had not been completed. The Supreme Court upheld the decision of the Mid-Canterbury Licensing Committing in refusing a license for an Ashburton hotel following the rearrangement of electoral boundaries.
