Hamilton, June 12. Mr Justice Cooper had a will case before him to-day. A Belgian named Courad Ferypens, who died on August 14th last year, left a will dated August sth, whereby he bequeathed the greaterpart of his 'estate to Albert Upton, farmer, Waimca, a stranger in blood. When probate was asked for several months ago, Mr Justice Cooper refused to grant it in common form, and m instructed that it be applied for in "solemn form, joining tho Public Trustee. When the renewed application came before Mr Justice Cooper to-day it was opposed by Mr Napier on behalf of the jiext-of-kin. James Ca-ughley, farmer, W-oodleigh, who attested the will, said lie and one John McKay were present when Ferypens signed the will in a bedroom 'Witness' and McKay then withdrew to tho kitchen, and there attested the will, as there was no table in tho bedroom.
