SALE OF PETROL AT PIRONGIA An appeal against a decision of the Bureau of Industry in refusing to grant Mr E. J. Papesch a retail license for the sale of petrol at Pirongia was heard before ’Judge Stephens at Hamilton on Friday of last week. On opening h?s case, counsel for the appellant (Mr A. R. Hill) submitted that the evidence to be called would show clearly the need for a further retail license at Pirongia. At present the only license was operated at Bell’s Store and although the proprietor did his best to provide a good service, he was not in a position to give anything like the service that a garage could give. There was considerable need for a garage at Pirongia and all repair work could be carried out. Mr Hill submitted that if he could satisfy the Court that his client intended to provide all garage facilities and service, then Mr Papesch was entitled to a license as 'of right. The only opposition, which was not represented, came from a Te Awamutu firm. Evidence was called from farmers in the Pirongia district in support of the appeal. In giving his decision, Judge Stephens stated that he was satisfied as to the need for a garage at Pirongia and that the appellant would be in a position to undertake all types of repair work. It was unreasonable that farmers should have to go to Te Awamutu, especially in cases of urgency, and he agreed with counsel that under the circumstances appellant was entitled to a license. The appeal was therefore allowed with appeal fees to be refunded.
