UNDEFENDED DIVORCES
“It is clear that a husband may be guilty of desertion in cases 1 where husband and wife have never cohabited.” declared Mr. Justice Herdman, in the Supreme Court yesterday afternoon, in dissolving the marriage of Madge de Lean and Harold de Leun. The suit, which was brought by the wife (Mr. Ray), on the ground of desertion, had the unusual circumstance that the couple had not lived together as husband and wife. | The marriage took place in Novemi her, 1926, according to petitioner, who ; said she returned to live at her father’x j home, where her husband visited and stayed with her from 11 a.m. til! 11 j p.m. daily. He was then living in Belgium Street. When she entered a nursing home later, it was arranged that they should take up life together On December 10 she received a cheerful letter from him, but her husband then disappeared and although she issued a warrant for his arrest tlio police were unable to trace him. On hearing he had gone to Australia she issued another warrant for his arrest there, but without success. A decree nisi was granted. Decrees nisi on the ground of separation were granted in the following petitions: Alice L. G. Litchfield (Mr. Goulding) against Sydney M. Litchfield: Percy Cohu (Mr. Wilkin) against Mary Margaret Cohu; Chas. S. H. Livingston (Mr. Singer) against Valerie F. Livingston; Walter Henry Dickson (Mr. J. F. W. Dickson) against Flora Camilla Eliza Dickson; Lyla May Turner (Mr. Bennett) against Alexander Turner. Orders for restitution of conjugal rights not having been complied with, decrees nisi were granted in the following petitions: Hilda Bish (Mr. Terry) against Leonard Oswald Bish; Catherine May Carder (Mr. Singer; against Lewis Everard Carder. On the ground of desertion a decree nisi was granted to Dagmar Vivienne i Donaldson (Mr. Dickson) against Robert Warne Donaldson.
