SEQUEL TO FATALITY
JUSTICES DISMISS CHARGE OF NEGLIGENCE ACCIDENT AT OHINEWAI (From Our Own Correspondent) HUNTLY, Monday. At the Huntly Police Court today, before justices of the peace, John O’Connor McCarthy was charged that on April 4 he drove a motorvehicle at Ohinewai in a negligent manner thereby causing the death of Francis Foster. Accused was represented by Mr. J. F. Strang, of Hamilton. The adjourned inquest and court proceedings were taken together. Sergeant J. T. Cowan, of Pukekohe, prosecuted on behalf of the police. The morning was occupied in hearing the evidence of Charles Allan Baker, salesman, ot Hamilton, Dr. Duncan Mac Diarmid, Lawrence Oldham, engineer Main Highways Board, and John Tai a native who was in the car at the time of the accident. The latter said he was alarmed at the speed the motortruck was being driven just before the fatality. The charge against McCarthy was dismissed on the grounds of insufficient evidence for the case to go forward for trial. At the coronial inquiry an open verdict was returned.
