TALLYMAN AWARDED COMPENSATION

Pleading that as the result, of injuries received while employed as a tally clerk by the Union Steam Ship Company, his earning power had been seriously affected, Arthur Yates, of Wright’s Road, Point Chevalier, asked that the company and J. Chevis pay him compensation in accordance with the Workers’ Compensation Act, 1925.

J. Chevis, carrier, was cited as a third party, plaintiff alleging that his injuries had been due to being struck by a bale of goods which defendant had sent down a chute from the top floor to the ground floor of Prince’s Wharf shed, and to defendant’s negligence in not. placing in position the guard provided by the Auckland Harbour Board.

The plea was heard at the Arbitration Court this morning before Mr. Justice Frazer. Mr. Jordan appeared for plaintiff, Mr. Bagnall for the Shipping Company, and Mr. Singer for Chevis.

Plaintiff’s claim stated his injuries were received through being thrown from a platform into a concrete yard on November 28, thus fracturing his thigh. He received compensation until September 10. when defendant refused to pay further compensation. Defendants claimed that plaintiff’s earning capacity was not affected. After legal argument his Honour gave judgment for plaintiff for compensation at the rate of £3 12s a week up to November. 1925. and for further compensation at the rate of 25 per cent, of 75 per cent, of full compensation for the remainder of the period of liability. Costs amounting to <£lo 10s. and medical expenses. £4 4«. were apportioned between defendants.
