PEDESTRIANS MUST KEEP LOOK OUT
MAGISTRATE’S WARNING MOTORIST PAYS DAMAGES There is equally a duty upon pedestrians as well as upon motorists to take proper care. ilf a pedestrian does anything unexpected, such as suddenly stepping off the footpath without looking to see whether any vehicular traffic is about, a motorist may be put in a position in which he is unable to avoid an accident. This was part of a judgment given yesterday* by T Mr. E. C. Cutten S.M., in which the duties of motorists driving in city streets were outlined. The case was one in which Philip Pavlovitch, labourer (Mr. Dickson) claimed £29 from R. C. Caddy (Mr. Sullivan) as damages for personal injuries and damages to clothing received when knocked down by defendant’s inotor-car in Victoria Street. The magistrate held that if defendant had been keeping a proper lookout he would have been able to avoid knocking the man down. The question of plaintiff’s possible neglect in walking across the street as he did was not the important factor, as defendant had opportunity to avoid the accident. Judgment was given for plaintiff for £l2 10s, with costs.
