was announced that the men were prepared to return to the ship. The magistrate thereupon agreed to re-hear the case against the men and withdraw the penalties imposed. The Mahia sailed later without the boatswain. Thirty men were charged with wilful disobedience of lawful commands and with being absent without leave. Their objection was to the boatswain. On the voyage to New Plymouth a seaman was lost overboard after an altercation with the boatswain, and the men alleged their comrade had been goaded by the boatswain who, at the Inquiry, was held not to be responsible for the seaman's death.
