DAMAGES CLAIM FAILS
Sequel to Collision NEGLIGENCE ALLEGED Press Association. —Copyright. Palmerston N., May 8. A claim for £IOOO general damages and £Bl 19s 4d special damages was heard in the Supreme Court this morning by Mr. Justice Reed, when James Henry Mann Dalton, plumber, of palmerston North, proceeded against Emily Barnes, married woman, of Palmerston North.
The action was taken as the result of a collision between defendant's car and plaintiff's motor-cycle and sidechair at the intersection of Broadway Avcnu'e and Albert Street on January 18. In his statement of claim plaintiff stated that as a result of the accident, he had completely lost the sight of his right eye. Both plaintiff and defendant alleged that the accident was due to negligence on tho part of the other. The jury returned a verdict for defendant Judgment was entered accordingly with costs, witnesses' _ expenses, and disbursements to be fixed by the registrar.
