NO ESCAPE FROM PENALTY. WELLINGTON, July 30. The plea that if defendant lost his license he also would bo deprived of his livelihood, was advanced by counsel in the Magistrate’s Court to-day when appearing for Fred Barnhouse, who pleaded guilty to a charge of being intoxicated while in charcg of a motor-car yesterday. Sub-Inspector Lopdell said that a constable’s attention ,vas drawn to an engine racing in Woodward Street, and he saw the driver of a car was having difficulty. After witnessing several unsuccessful attempts, the constable went over and found accused intoxicated. He was taken to the police station, where about 50 minutes afterwards ho was examined by a doctor, who certified that accused was not in a Jit state 10 drive a car.

Mr E. Pago, S.M., fined accused £2O. “I realise,” said Mr Page, dealing with the question of the license, ‘‘that when a man earns bis living in a motorcar it is a severe penalty to lose his license for a time, but the offence is a serious and dangerous one and 1 propose to cancel his license for three months.’ ’
