charge that failed. ABANDONED EVIDENCE. SYDNEY, December 15. Six weeks ago, 25 freshwater fish were fount! in the backyard. of a house in Forbes, occupied by John Buckley. They were set aside as an exhibit in court proceedings, which were held yesterday, when Buckley was charged with “ebing unlawfully in possession of fish taken from a close fishery in, contravention of the Fisheries Act.” But fish are hard to keep in Forbes—especially for sis weeks, The police inspector Unlade determined efforts, but the expenditure of about £3O in ice was of no avail. The exhibit, after three weeks, commenced to make its presence felt, and the inspector, perforce, had to abandon that much of his evidence. "When the case was heal'd, Mr Meillon, for Buckley, pointed out that there was no evidence that the fish had come from a close fishery. They could have come from Victoria, he said. The magistrate, Mr Arnold, agreed. The case was dismissed. Permission to charge 'Buckley being in possession of fish, suspected of having been unlawfully obtained), was refused.
