Federal Judge Woodrough upheld the seizure of British ships which hover about the three mile limit for the purpose of landing liquor cargoes, either directly or indirectly, in co-operation with other craft. The judgment declared that when a British vessel was caught in such an act, even though it was beyond the three-mile limit, it seizure was justified.

The judgment,wa s delivered in the case of the British vessel Marion Mcsher, which was captured last year, delivering liquor to small boats. The Marion Mosher was released on a bond, and ordered to Canada. The vessel continued to make deliveries, whereupon the hond was confiscated, and the surety company sued the United States Government, losing the case. The decision is regarded as an important interpretation of th© United States power of seizure.
