MONEY IN WALLET
Two Constables To Share 785 Dollars (P.A.) WELLINGTON, December 13. Mr A. M. Goulding, S.M., gave judgment in the case of Constables Brady and Cook, who each claimed 785 dollars in a wallet which they found last April. Sub-Inspector Mclntyre also claimed on behalf of the Crown. The Magistrate decided that there was nothing in the Police Force Act to deprive a member of the force of his common law rights and no authority had been quoted supporting the Crown’s claim. The Magistrate explained that treasure trove must have been concealed, and not merely lost or abandoned. This money was not treasure trove. Therefore, the Crown had no claim. Constable Cook saw what he thought was a wallet in the road and drew Constable Brady’s attention to it and Constable Brady picked it up. The Magistrate said that both had a hand in recovering it, but neither knew what was in it till it was opened and they examined it. He decided they were equally entitled to the money.
